Indaver Ireland have formally abandoned plans to appeal Mr Justice Kearns’ Costs Order against them which the Judge made two weeks ago, following costs claims from Bord Pleanala and CHASE as a result of Indavers last-minute withdrawal of a High Court Challenge of the Board’s planning refusal.
In his ruling of 21 January 2012, High Court President Mr Justice Kearns found that after a certain point (10th September 2012) Indaver conducted the case in a manner that ‘can only be seen as an abuse of the court process’.
CHASE Chairperson Mary O’Leary said “ Indavers manipulative approach to the planning process, including the legal process has been exposed, and we are glad that the disreputable manner in which they conducted themselves in court was recognised. We are pleased that this court appeal has now been closed, leaving the Ringaskiddy site without planning, but we are under no illusion about Indavers intentions.’
