Indaver Breach Trust with New ‘Pre-Application Consultations’

September 10, 2012 by CHASE

“Even if the outcome is not in our favour, we will walk away from this application – there will be no more court battles.” Jackie Keaney, Indaver Ireland Commercial Director, Irish Times 30/11/2011

Indaver have surprised local residents with revelations that they are once again in ‘pre-application consultations’ with An Bord Pleanala for their Ringaskiddy site, contrary to assurances given by Indaver that whatever the final outcome of the 2008 application, the company would accept it as final.

These intentions were repeated in The Irish Times of 30 November, 2011 by Indaver Ireland Commercial Director, Jackie Keaney, who referring to Indavers High Court challenge to An Bord Plenala’s refusal of planning permission said  “Even if the outcome is not in our favour, we will walk away from this application – there will be no more court battles.” View Irish Times Article

CHASE Chairperson Mary O’Leary challenged Indavers integrity saying “An Bord Pleanala rejected their application on sound planning grounds.  Indavers latest U-turn highlights the real issues communities have in standing up to big business and their unlimited war chest.  This is a prime example of arrogance and bullying by a private company who will go against all sound planning policy to get their own way in the name of profit.

Indaver clearly has no regard for either due process or the local community.  How can we trust a company that says one thing, then does the opposite with such ease.”

Indavers High Court challenge to An Bord Pleanala’s planning refusal is listed for hearing on October 23rd, 2012
